Why California takes weeks to count votes — and why officials say that's by design

Days after polls closed in California’s primary election, with key races for governor and other offices still unresolved, election workers in cavernous counting centers across the state continued the methodical work of verifying, opening and tabulating millions of mail-in ballots. Provisional ballots, signature mismatches and late-arriving envelopes added to the pile.

It is a familiar scene in the nation’s most populous state, where results often trickle in over weeks rather than hours. While much of the country wakes up to near-final tallies the morning after Election Day, California’s process — shaped by laws prioritizing broad voter participation — routinely extends into the following days or even longer.

The reasons are structural, not conspiratorial, though the delays have long invited skepticism and outright accusations of manipulation, particularly from conservatives frustrated by the state’s Democratic dominance.

The mechanics of delay

At the heart of California’s system is universal vote-by-mail. Every registered voter automatically receives a ballot, and roughly 80 to 90 percent use it. Ballots can be returned by mail if postmarked by Election Day and received up to seven days later, dropped off at secure boxes or cast in person.

This creates what Kim Alexander, president of the nonpartisan California Voter Foundation, calls the “pig in the python” effect: a massive surge of ballots arriving at the last minute that must each undergo signature verification against voter records. Mismatches trigger notifications allowing voters a cure period — often weeks — to verify their identity.

Additional steps include processing provisional ballots, same-day registrations and damaged envelopes that require duplication. State law gives counties up to 13 days for most unofficial results (a recent tightening from 30 days) and 30 days for full certification, though competitive races and high volumes can stretch the timeline.

“California’s election laws allow voters more time and more options,” one elections official explained in a recent briefing. “That comes at the cost of speed.”

Contrasts With India, Texas and Florida

The disparity stands in sharp relief against other large democracies and states.

India, home to the world’s largest electorate, managed to count hundreds of millions of votes from its 2024 Lok Sabha elections in essentially one day. Voting occurred in phases over weeks, but on counting day — June 4, 2024 — results poured in rapidly thanks to widespread use of Electronic Voting Machines with paper audit trails, centralized counting centers and strict national coordination. Full national results were clear within hours of counting beginning.

Closer to home, Texas and Florida — both massive states with millions of voters — routinely deliver near-complete results on Election Night or within 24 hours. Florida overhauled its system after the 2000 recount debacle, imposing tight receipt deadlines for mail ballots (must arrive by 7 p.m. Election Day), allowing early processing and emphasizing in-person and early voting. Texas similarly maintains stricter deadlines and continuous counting post-polls.

“Florida has nearly all ballots counted on Election Day, while California can take weeks,” as one analysis of state practices noted.

Criticisms and defenses

Critics, including former President Donald Trump and Republican candidates, argue that the delays erode public confidence and create opportunities for abuse. They point to ballot harvesting (legal in California), extended cure periods, postmark rules and the partisan tilt of late urban and mail votes as vulnerabilities, even as studies consistently show mail-in fraud remains exceedingly rare.

“Votes are all tied up. May not be in for weeks,” Trump posted recently amid California’s ongoing count, echoing long-standing claims of irregularities.

Some Republican candidates in the current cycle have called for faster processing and emergency measures to accelerate counts. Others highlight California’s lack of strict photo ID requirements at polls, relying instead on signatures and rosters.

Defenders, including Secretary of State Shirley Weber and county officials, counter that the system is designed for accuracy and inclusion in a diverse state of 39 million people. “Every legal vote counts,” Weber has emphasized. The process includes multiple safeguards, audits and public observation. Recent laws aim to speed things up without sacrificing access.

Kim Alexander and others note that rushing the count could disenfranchise voters whose ballots arrive slightly late through no fault of their own or who need time to cure minor errors. “We don’t want delays in the Postal Service to disenfranchise voters,” one official said.

A national tension

California’s approach reflects a broader American debate under federalism: states set their own election rules, balancing turnout, security and timeliness differently. Universal mail voting boosted participation during the pandemic and beyond, but it has also fueled distrust in an era of polarized politics.

As results continue to update in California — with some races potentially heading to July for fuller clarity — the state’s voters, candidates and observers are once again reminded of the trade-offs. Speedy results build confidence for some; ensuring every eligible voice is heard reassures others. Reconciling the two remains an unfinished project in the nation’s largest laboratory of democracy.
